Czech Populist Prime Minister-Elect Refuses to Sell Corporate Holdings Amid Ethical Dispute

Andrej Babiš, the self-proclaimed billionaire who secured victory in last month's Czech election, has declined to sell his vast corporate assets, while asserting he will resolve a ethical dilemma that could prevent him from assuming the role of prime minister.

Position on Corporate Empire

Babiš, whose ANO party came first in the autumn election but lacked a parliamentary majority, stated in a social media post that he would not sell his Agrofert conglomerate, which operates in farming, food production, and chemical industries.

“I have consistently said I will not sell Agrofert. I have consistently stated I will resolve the conflict of interest in compliance with national and EU regulations,” Babiš commented. “This is different from selling a pastry in a bakeshop.”

President's Demand

The Czech president, Petr Pavel, stated that the 71-year-old political figure must clarify openly how he will remove conflicts of interest arising from his business activities before assuming the role of prime minister.

The Czech constitution “explicitly requires the head of state to consider the possible emergence of a ethical issue and the ways to address it” when appointing government ministers, the presidential administration explained.

The head of state “wants it to be clear in what specific way Andrej Babiš will fulfil his constitutional and legal obligations”, the statement said, stating that Pavel was ready to appoint Babiš as premier “without delay” once the matter was settled.

Corporate Activities and Regulatory Issues

Babiš's numerous companies, primarily under the Agrofert umbrella, function in the nation and other central European states, receiving substantial funds in national and EU agricultural and other subsidies, as well as government deals.

Under national legislation, cabinet members cannot receiving public aid or agreements. The ethics watchdog Transparency International has indicated that to avoid a ethical breach, Babiš must either divest, decline public contracts, or not enter government.

Past Tenure and Present Intentions

Babiš said he would “follow the regulations” if selected as premier, but declined to explain how in beforehand because the issue was “an highly personal and personal matter for me, and journalists will invariably criticise me anyway”.

During his first term as prime minister, from 2017 to 2021, Babiš encountered several legal battles and an EU investigation over possible ethical issues. He placed his holdings into fiduciary arrangements, while retaining certain control over them.

A court and the European Commission both ruled that this did not suffice. Babiš confirmed recently that he was again the exclusive proprietor of Agrofert and insisted he was “implementing measures” to avoid a ethical problem, but declined to disclose specifics.

Governing Agreement and Foreign Policy Consequences

The wealthy politician has signed a governing pact with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has primarily opposed the EU’s environmental policy.

The new government, if approved, is likely to strengthen the populist movement in the region and might challenge western support for Ukraine – although Babiš has called Ukraine’s president, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as president shares responsibility for foreign policy, also requested that the coalition’s programme include a declaration on the official stance on Russia’s war in Ukraine, including a commitment to fulfilling alliance duties.

The head of state has earlier stated he would not endorse any cabinet candidates who might question the nation's international alliances, a condition that the ultra-conservative party has indicated it will satisfy by proposing independent technocrats.
